1. Introduction
   1. The Schedule to these Terms and Conditions forms an integral part of the conditions of entry. Participation in this Promotion is deemed acceptance of these Terms and Conditions.

2. Eligibility
   1. Entry is open to permanent residents of Australia aged 18 years and over, excluding:
   2. Directors, management, employees, officers, and contractors of the Promoter, the Promotion Sponsor, any related bodies corporate, and agencies associated with the Promotion.
   3. Immediate family members of the individuals.
3. Entry
   1. The Promotion commences and closes on the dates and times specified in the Schedule. All times noted in these Terms and Conditions are local times, based on the location of the Promoter.
   2. To enter, entrants must follow the Entry Method outlined in the Schedule during the Promotional Period.
   3. Entrants are permitted to submit only one (1) entry as specified in the Schedule. Additional entries, if permitted, must be submitted separately, and must uniquely address the promotional question, if applicable.

4. Prizes and Winning
   1. The draw will take place at the address and on the date/time specified in the Schedule by a random drawing process.
   2. The number of winners and prizes are as outlined in the Schedule.
   3. Each winner will receive the prize(s) detailed in the Schedule.
   4. Total Prize Pool value is as stated in the Schedule.
   5. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
   6. Winners will be notified in accordance with the Winner Notification section of the Schedule.

5. Prize Conditions
   1. Winners must accept prizes in the form in which they are offered.
   2. The Promoter shall not be liable for any loss, damage, or injury or sustained (even if caused by negligence) because of accepting and/or using a prize, except for any liability which cannot be excluded by law.

6. Privacy
   1. The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Promotion.

7. General
   1. The Promoter’s decision in relation to all aspects of the Promotion is final and binding on all who enter, and no correspondence will be entered into.
   2. The Promoter reserves the right to request winners to provide proof of identity, proof of residency, and/or proof of entry validity in order to claim a prize. Proof of identification, residency, and entry considered suitable for verification is at the discretion of the Promoter.
   3. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the Promotion as appropriate, subject to any directions from a regulatory authority.

8. Disputes
   1. In the event of a dispute concerning who submitted an entry, the entry will be deemed to have been submitted by the registered holder of the email account from which the entry is made.

9. Limitation of Liability
   1. The Promoter and its associated agencies and companies will not be liable for any damage, loss, or delay suffered by any entrant entering the Promotion or as a result of accepting any prize.
   2. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilized in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorized access to or alteration of entries.

10. Legal Compliance
    1. The Promoter will not be liable for any failure to comply with its obligations if the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.

11. Copyright and Intellectual Property
    1. By submitting an entry, entrants grant the Promoter a perpetual, royalty-free, non-exclusive license to use, reproduce, publish, and display their entries in all media throughout the world for any purpose, including but not limited to future promotional, marketing, or publicity purposes, without any compensation or prior notice.

12. Modification of Terms

1. The Promoter reserves the right, at any time, to modify these Terms and Conditions, and alter the conditions of the Promotion for any reason. Changes to the Terms and Conditions will be published on the Promoter’s website.

13. Governing Law
    1. These Terms and Conditions are governed by the laws of the State of New South Wales, Australia. Entrants submit to the exclusive jurisdiction of the courts of that State.

14. Promotion Amendments
    1. The Promoter reserves the right to cancel or amend the Promotion and these Terms and Conditions without notice in the event of catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control.

    1. Any queries regarding the Promotion should be sent to the Promoter at the address listed in the Schedule.

16. Winner Publication
    1. The names of the winners may be published on the Promoter’s social media profiles, website, or in other promotional materials. This publication will serve as a method for the Promoter to provide transparency and promote the integrity of the competition.

17. Unclaimed Prizes
    1. If any prize remains unclaimed for more than 30 days after the date of the winner notification, the Promoter reserves the right to redraw the prize. The redraw will take place at the same place as the original draw and be subject to the same terms and conditions, notifying any new winner promptly.

18. Publicity Rights
    1. By participating in the Promotion, winners agree to participate in any media or promotional activity resulting from the Promotion as reasonably requested by the Promoter at the Promoter’s expense and agree that the Promoter may use their names and images in promotional material. The inclusion of any such promotions, media, or publicity does not constitute an endorsement of the Promoter’s products or services.

19. Data Protection
    1. All personal information supplied by entrants will be used by the Promoter for the purpose of this Promotion and may be shared with other entities assisting with this Promotion. The Promoter is committed to respecting entrants’ privacy rights and safeguarding their personal information in accordance with applicable data protection laws.

20. Non-Waiver

21. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights, nor will it limit the rights of the Promoter to take subsequent actions.

22. Severability
    1. If any provision of these Terms and Conditions is held to be illegal, invalid, or unenforceable by a court of law, that provision will be severed from these Terms and Conditions and the remaining provisions will remain in full force.

23. Interpretation
    1. Any ambiguity in these Terms and Conditions will not be construed against the drafting party.

24. Complaints Procedure
    1. Entrants who wish to make a formal complaint about any aspect of the Promotion should forward a written complaint to the Promoter’s address. The Promoter will respond to all complaints within 30 days of receipt.

25. Rights Reserved by Promoter
    1. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any entrant who submits a fraudulent entry or interferes with the entry process, or who does not comply with these Terms and Conditions. Verification is at the discretion of the Promoter, whose decision is final and binding.

26. Technology Malfunctions
    1. The Promoter is not responsible for any technical malfunction of any communications network, system, computer equipment, software, or any combination thereof, including any injury or damage to entrants or any other person’s computer related to participation in or downloading any materials in this Promotion.

27. Force Majeure
    1. For events that are beyond the reasonable control of the Promoter, including acts of God, civil disturbances, strikes, riots, and disruptions of network connectivity, the Promoter may either suspend, terminate, modify or reduce the promotional period without liability to any entrant or other third party.

28. Promotion Variations
    1. The Promoter may vary the terms of, or terminate, this Promotion at any time at its absolute discretion without liability to any contestant or other person. All changes to the Promotion will be posted in revised Terms and Conditions on the Promoter’s website.

29. Decisions Final
    1. All decisions made by the Promoter or its nominated agents regarding any aspect of the Promotion are final and no correspondence will be entered into.

30. Indemnity
    1. By entering this Promotion, each entrant agrees to release, discharge and hold harmless the Promoter, its legal representatives, affiliates, subsidiaries, agencies and their respective officers, directors, employees and agents from any damages whatsoever suffered or sustained in connection with the Promotion or the acceptance of the prize.

31. Financial Advice
    1. Nothing in the terms of this Promotion is intended to constitute financial advice and should not be taken as such. Entrants should seek independent financial advice from professionals.

32. Intellectual Property
    1. By submitting an entry, the entrant grants the Promoter a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, worldwide license to use any intellectual property rights existing in their entry. This includes the right to copy, publish, display, alter, distribute, and create derivative works from the entry without any further consent, notice and/or compensation to the entrant.

33. Advertising and Promotion
    1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

34. Compliance with Laws
    1. This Promotion will be administered in compliance with all applicable local laws and regulations, including but not limited to privacy laws, anti-spam laws, consumer protection laws, and regulatory guidelines.

35. Record Keeping
    1. The Promoter will maintain all records related to the Promotion and entry submissions for a minimum period as mandated by relevant laws and regulations, ensuring compliance with data handling and privacy legislation.

36. Access to Terms
    1. These Terms and Conditions are available on the Promoter’s website throughout the Promotional Period. Entrants agree that accessing this document online constitutes sufficient provision of these Terms and Conditions.

37. Jurisdiction
    1. The Promotion is deemed to be conducted in New South Wales, Australia, regardless of where the website is accessed from. As such, these Terms and Conditions are governed by the laws of New South Wales and the Commonwealth of Australia.

38. Language
    1. All promotional materials and these Terms and Conditions are presented in English. Any translation into other languages will not be provided by the Promoter.

39. No Affiliation
    1. This Promotion is in no way sponsored, endorsed, administered by, or associated with any social media platforms where this Promotion may be promoted

41. Ethical Conduct
    1. Entrants agree to conduct themselves in a respectful and responsible manner when participating in any aspect of the Promotion, including interactions with other entrants and the Promoter’s staff.

42. Promotion Management
    1. The Promoter reserves the right to appoint third-party agencies to manage certain aspects of the Promotion, including but not limited to entry collection, prize management, and data processing.

43. Consumer Rights
    1. Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) and other relevant legislation. Where any provision of these Terms and Conditions would cause any consumer guarantee, warranty or condition to be void, that provision shall be read down to avoid that where possible, or otherwise severed, without abating the validity of the remainder of these Terms and Conditions.

44. Confidentiality
    1. All information shared during entry into the Promotion, including personal details and any financial discussions, is treated as confidential. The Promoter will not disclose any non-public information to third parties except as required under law or by the terms of the Privacy Policy.

45. Changes to the Promotion
    1. The Promoter reserves the right to make changes to the Promotion at any time, which may include modifying the Promotional Period, altering the number of winners or the prize amounts, or cancelling the Promotion if required by unforeseen circumstances or external factors beyond the Promoter’s control.

46. Safety and Risk
    1. The safety of participants is paramount. Entrants agree to follow all safety instructions and guidelines provided by the Promoter during the Promotion. The Promoter is not responsible for any injury or harm resulting from participation in the Promotion unless caused by the negligence of the Promoter.

47. Prize Acceptance
    1. Winners may be required to sign a declaration of eligibility and liability/publicity release as a condition of accepting the prize. Failure to comply with this requirement may result in forfeiture of the prize.

48. Prize Delivery
    1. Prizes will be delivered to the winners at the address provided during entry or via electronic means if appropriate. The Promoter is not responsible for prizes lost, delayed, or damaged in transit.

49. Publicity and Marketing
    1. Participation in the Promotion constitutes consent for the Promoter to use the entrant’s personal details for marketing and promotional purposes across all media, including but not limited to digital and print formats, without further compensation, unless prohibited by law.

50. Audit and Oversight
    1. The Promotion will be subject to ongoing audit and oversight to ensure fairness and compliance with procedural guidelines. This may involve internal or external agencies to monitor adherence to the terms and the integrity of the Promotion.

51. Final Provisions
    1. The Promoter may waive any of these terms in its sole discretion on a case-by- case basis. Such waiver does not waive any other terms or the same term on a future occasion.
    2. Where this Promotion involves complex interactions or the chance to make significant financial decisions, entrants are advised to seek independent professional advice.
    3. These Terms and Conditions, together with any promotional materials or Schedule, constitute the entire agreement between the entrant and the Promoter regarding the Promotion.

52. Acceptance of Prize
    1. Acceptance of any prize constitutes permission for the Promoter to use the winner’s name, likeness, and entry for advertising and future promotional purposes without additional compensation, except where prohibited by law.

53. Acknowledgement of Understanding
    1. By entering, participants acknowledge that they have read, understood, and voluntarily agree to abide by these Terms and Conditions, with a clear understanding of the consequences of any breach.
